Even though the user had all the necessary rights to the folder they were not the owner. Once I forced the ID as the owner it worked. I did not think to look that far as it was working on Windows 7.

The problem is I am setting up a new domain controller with a new domain and the file server is still on the old domain. Both domains are in a trust so data and rights can pass through. So the solution to this case is to make sure the user is the owner of the folder. Something I am going to have to fix when I migrate the rest of the users over to the new domain.
